You represent and warrant that you own or control all rights to the User-Generated Content you submit and that the User-Generated Content is accurate, not confidential, and not in violation of any contractual restrictions or other third-party rights. Rudbeckiarn is not responsible for any User-Generated Content and assumes no liability for any claims, damages, or losses arising from such content.

We reserve the right to remove or edit any User-Generated Content for any reason, including but not limited to violations of these Terms or applicable laws.

7. Payment Terms

Access to certain features of our services may require payment of fees. You agree to pay all fees and charges associated with your use of the services in accordance with the pricing and payment terms set forth on the Site. All fees are non-refundable unless otherwise stated.

By providing a payment method, you represent and warrant that you are authorized to use that payment method and that you authorize us to charge your payment method for the total amount of your order. If your payment method fails or your account is past due, we may suspend or terminate your access to the services.

We reserve the right to change our pricing and payment terms at any time. Any changes will be effective immediately upon posting on the Site, and your continued use of the services after such changes constitutes your acceptance of the new pricing and payment terms.

In no event shall Rudbeckiarn’s total liability to you for all damages, losses, and causes of action exceed the amount paid by you, if any, for accessing the services during the twelve (12) months preceding the claim.

Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you. In such jurisdictions, Rudbeckiarn’s liability shall be limited to the fullest extent permitted by law.

10. Termination

We may terminate or suspend your access to our services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the services will immediately cease.

All provisions of these Terms which by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
